SIOUX FALLS, S.D. (KELO) -- Opponents and supporters have been arguing sides of Senate Bill 201 for months and in November, South Dakota voters will determine the fate of SB201, a bill related to carbon dioxide pipelines (CO2).
Referred Law 21 as it relates to SB201 will appear on the 2024 general election ballot after the Secretary of State validated more than 17,500 signatures required to refer the state law to a statewide vote. SB201 passed the Legislature and was signed by Gov. Kristi Noem but the petition by opponents delayed its implementation. If the ballot question passes with a "yes" vote, SB201 becomes law. A "no" vote would SB201 from becoming law.
Supporters of SB201 call it the "Landowner Bill of Rights." It would require require carbon dioxide carriers to pay a surcharge of $1 per linear foot of carbon dioxide pipelines. Opponents say SB201 takes away landowner rights in favor of a for-profit private company.
