On May 28, 2022, Whipple was drinking alcohol and smoking marijuana at his Rosebud residence. He departed his home in a vehicle that he knew had faulty brakes. While driving, Whipple ran a stop sign and struck a passing pickup truck. A five-year-old child was riding in the pickup truck bed and suffered fatal injuries from the crash.

Whipple was indicted by a federal grand jury in February of 2023 and plead guilty on March 18, 2024.
