Indiana Senate passes bill to ban hemp-based THC products for those under 21

INDIANAPOLIS (WISH) — A bill to ban hemp-based THC products for people younger than 21 was advanced by the Indiana Senate with bipartisan support on Wednesday.

Senate Bill 250, authored by state Sen. Aaron Freeman, R-Indianapolis, would also alter Indiana’s definitions of hemp to match new language passed by Congress.

The bill also closes what some people call the “Farm Bill loophole,” language taken from the 2018 federal Farm Bill that created a legal gray area for products containing Delta-8 THC and other synthetic forms of THC. In 2025, Congress updated its law to ban products with high amounts of THC, and the Indiana Senate bill would do the same at the state level.

“Under the farm bill loophole, Delta-8 and THC products have become too easy for young Hoosiers to obtain,” Freeman said in a statement. “Senate Bill 250 is about protecting those under 21 by preventing them from obtaining products containing THC.”

With the federal government discussing the reclassification of marijuana, this bill would also reconstruct Indiana’s laws. Current Indiana laws would automatically lower a drug on state’s drug schedule if the federal government made the change.
